The role, appointment and dismissal of the vice mayor
(1) The vice mayor is subordinate to the mayor and, in the situations provided by law,
the rightful substitute of the mayor, in which case he exercises, on behalf of the mayor, the
attributions that belong to him. The mayor can delegate some of his attributions to the vice mayor.
(2) The vice mayor is elected, by secret vote, with an absolute majority, from among the members
of the local council, at the proposal of the mayor or the local councilors.
(3) The vote is cast using voting ballots. The election of the vice mayor is
done by a decision of the local council.
(4) In the situation where two vice mayors are elected, the candidates who have
obtained the absolute majority vote are declared elected. In this situation, the local council designates, by
decision, which of the two vice mayors will first exercise the position of rightful substitute of the
mayor.
(5) The dismissal of the vice mayor can be done by the local council, by adopting a decision,
by secret vote, with a two-thirds majority of the number of councilors in office, at the
well-founded proposal of the mayor or one third of the number of local councilors
in office. The dismissal of the vice mayor cannot be done in the last 6 months of the
term of the local council.
(6) The local councilor who is running for the position of
vice mayor, respectively the vice mayor in office whose replacement is proposed, also participates and votes in the deliberation and adoption of decisions regarding the election or dismissal of the vice mayor.
(7) During the term of office, the vice mayor retains the status of local councilor,
without benefiting from the allowance associated with this status, being subject to the incompatibilities
specific to the position of vice mayor provided by Book I Title IV of Law no. 161/2003, with
subsequent amendments and completions.
(8) The term of office of the vice mayor is equal to the term of office of the local council. In
the event that the term of office of the local council ceases or the status of local councilor ceases,
before the normal duration of 4 years expires, the mandate of the vice mayor also ceases
automatically, without any other formality.
